A Quiet Estate Home Sale in San Diego: How It Works

For trustees, executors and families who would rather not make a public event of an estate sale: where a quiet launch can fit, where the law keeps a sale public, and how to keep everyone confident in the price.

PRIVATE ESTATE SALES · NOVEMBER 2026

An estate sale is personal. Some trustees and executors would rather skip the open-house crowds and the online chatter, and sometimes they can. Here is where a quiet sale fits, where it doesn’t, and how to keep the price easy to defend.

Weighing a quiet sale for an estate or trust home? Four quick questions, and Rudy follows up privately.

Who decides how quiet the sale is?

The trustee, or the representative the court appointed, decides with their attorney. A trustee acts for the beneficiaries, with reasonable care and good records, as the Orange County court’s guide to trusts lists. A personal representative is an officer of the court, and form DE-147 spells out what that means.

Quiet never means secret from the heirs or beneficiaries. In a trust, they receive the trustee’s notice and the trustee’s reports; when an estate sells with a Notice of Proposed Action (form DE-165), that notice states the price and the commission.

When is an estate sale public by design?

A sale the court confirms. In San Diego, Local Rule 4.13.1 has the notice of sale published (the Probate Code lists a few exceptions), and at the hearing other buyers can overbid in open court (forms DE-165 and DE-260; Local Rule 4.13.11). The court’s report even asks what was done to expose the home to the market.

That path isn’t built for a quiet launch, and that is by design: the court wants the widest field of buyers.

Where can a quiet sale fit?

  • A trust sale under the trust’s terms, since trusts are not registered with the court and the trustee follows the trust.
  • An estate with full authority that sells by Notice of Proposed Action. The heirs still receive the terms and can object (DE-165).

How quiet a launch can be also depends on rules set by NAR, the MLS and the brokerage: coming-soon windows, office-exclusive options and the disclosures a seller signs. The details, MLS by MLS, are on our compare-your-options page, and private, coming soon or public weighs the trade-offs.

How does a quiet sale still show the price was fair?

Privacy and a well-documented price can go together. Four habits do most of the work:

  • A written value for today, and recent nearby sales around the date of death for your CPA or appraiser.
  • A quiet window with an end date, then a public launch if the right buyer hasn’t appeared.
  • Every offer logged and shared with the attorney or the trustee.
  • Reach through the Private Buyer List, so a quiet sale still meets more than one buyer.

For the longer version, see how sellers know a fair price without the MLS.

Who Rudy works for. On a quiet estate sale, Rudy and Coldwell Banker West represent the trustee or the estate as the seller. If a buyer from the Private Buyer List wants the home, Rudy can represent both sides only if everyone agrees in writing, and that buyer can also bring their own agent.

Small privacy touches for any estate sale

  • Marketing that describes the home, never the family.
  • Photos without family pictures or personal papers.
  • Showings by appointment only.
  • Our confirmation emails from this site never name the topic of your inquiry.

Share the address and a few details. Rudy reviews the recent comparable sales and replies privately with a written value for today, plus recent nearby sales around the date of death if your CPA or appraiser needs them. A comparable-sales review is not an appraisal.

Common questions

Can an executor sell a house off-market in San Diego?

It depends on the authority the court granted. A representative with full authority sells by Notice of Proposed Action, which goes to the heirs with the price and commission; a sale that needs court confirmation is published and can be overbid in court. The estate attorney confirms which applies.

Is a trust sale private?

Trusts aren’t registered with the court, and a trustee follows the trust’s terms, so a trust sale can be quieter. Beneficiaries still receive the trustee’s notice, and the trustee keeps records and reports.

Does a quiet sale mean a lower price?

It trades some reach for privacy. A written value, a set quiet window and a log of every offer help the trustee or executor show the price was fair.

Who sees the offers?

In an estate sold by Notice of Proposed Action, the notice states the material terms, including the price. In a trust, the trustee shares what the trust and the attorney call for.
